What are cookies?
Cookies are small text files sent from the website visited by the user to the user's device (usually to the browser) where they are stored so that the device can be recognised on its next visit. On each visit, the cookies are sent to the website user's device again.
Each cookie generally contains: the name of the server the cookie was sent from; expiry date and a value, usually a single number generated casually by the computer. The website server transferring the cookie uses this number to recognise you when you make a return visit or surf from one page to the next.
Cookies can be installed not only by the manager of the website visited by the user (first party cookies), but also by another website installing cookies through the first website (third party cookies) and can recognise them. This happens because the website visited could have elements (images, maps, sounds, links to other domain web pages, etc.) residing on other servers.
Depending on purpose, cookies are divided into technical cookies and profiling cookies.
Technical cookies are those only used to "transmit a communication on an electronic communication network, or to the extent strictly needed by the supplier to supply a company service, information specifically requested by the subscriber or user to supply that service" (see art. 122, clause 1, of the Privacy Code, as amended by Legislative Decree 69/2012). More specifically, those cookies are usually used to enable efficient navigations between pages, memorise user preferences (language, country, etc.), for computer authentication, to manage the cart or permit online purchases, etc. Some of these cookies (called essential or strictly necessary) enable functions without which no operations would be possible. In compliance with art. 122, clause 1 of the Privacy Code , use of technical cookies does not require user consent.
Technical cookies are assimilated with the so-called analytic cookies if used directly by the website manager to collect aggregate data on number of users and on how they visit the website itself. Those cookies enable website owners and/or managers to understand how users interact with website content, in order to optimise it.
Profiling cookies are used to track user navigation, analyse its behaviour for marketing purposes and create profiles on tastes, habits, choices, etc.; to transmit targeted advertising messages related to the user's interests and consistent with preferences shown when surfing the web. Those cookies can only be installed on the user's computer if the latter has specifically consented, using the simplified modes indicated in the Provision.
Based on their duration, cookies are persistent, remain memorised on the user's device until they expire, unless the latter should remove them; and session, are not memorised persistently on the user's device and vanish when the browser is closed.
